The Delhi Government, ruled by the AAP has challenged the ordinance of the Center in the Supreme Court, which ensured asserting control of the Group-A bureaucrats by the Central Government overpowering the local one in the issue of administering and governing Delhi. Right from the time the idea was conceptualized, the Aam Aadmi Party in Delhi had been up in arms against the ruling government on the issue, but couldn’t put up a stiff resistance till now. The Delhi Govt. finally decides to challenge the order in the Supreme Court labeling it as unconstitutional and infringing on the jurisdictional powers of the regional administration.
AAP vs Delhi Government
The AAP government filed their appeal on Friday, 30th June 2023 in the Supreme Court of India challenging the Ordinance that the Central Government had issued in the Parliament regarding exercising their authority and control over the bureaucrats surpassing the Delhi Govt. The challenge comes after about a month-and-half of the same issue being challenged successfully by the same Aam Aadmi Party in the Supreme Court regarding the Constitutional validity of the same, where the stand of the Aam Aadmi Party had prevailed. It is to be believed that the decision of the Supreme Court in favor of the Aam Aadmi Party prompted the Central Government in promulgating the Ordinance.
Claims made by Aam Aadmi Party on the issue
The ruling Government of Delhi had approached the SC initially in the month of May 2023 through a writ petition challenging the Government of National Capital Territory Ordinance 2023, which is termed by them as an infringement of the rights of administration and jurisdiction. AAP also planned to burn the effigies of the Ordinance throughout Delhi between 6th July and 13th July. “When a copy of the ordinance will be burnt in every corner of Delhi, it will be clear that the people of Delhi are not happy with this black ordinance and the central government. The Prime Minister has cheated Delhi, and the people are angry,” Bhardwaj said.
As per the latest news update, the AAP had been trying their best to garner support from the Opposition on the issue so that the Ordinance can be defeated in the Rajya Sabha and has been somewhat successful in doing so, with the only exception of the Congress Party which are yet to clarify their stand on the issue.
